DN MEYER Show Your Colors Promotion ** PLEASE READ THIS IMPORTANT INFORMATION ** Before submitting your photo to the DN MEYER Show Your ColorsTM promotion (Promotion), you must read the terms outlined in the Photo Release and Consent Agreement below, then click the "I Agree" button to proceed. By clicking I Agree, you acknowledge that you have read the Photo Release, agree to be bound by all of the terms and conditions, and wish to participate in the Promotion. PHOTO RELEASE AND CONSENT AGREEMENT By submitting your photo(s) (the "Content"), you hereby grant to Meyer Paints, its affiliates, subsidiaries, assigns, licensees, and legal representatives ("DN MEYER") the irrevocable, perpetual, worldwide right to use, reproduce, edit, market, store, distribute, have distributed, publicly and privately display, communicate, publicly and privately perform, transmit, have transmitted, create derivative works based upon, and promote the Content (as such may be edited and modified by DN MEYER in its discretion, including but not limited to composite or distorted representations or derivative works made in any medium) through the BEHR website and through such other publishing or distribution channels as DN MEYER may designate in any medium now known or hereafter devised, for editorial, commercial, promotional, advertising and all other purposes. While you retain ownership of all right, title, and interest in and to the Content itself, you consent and agree that DN MEYER owns all right, title, and interest in and to any compilation, collective work or other derivative work(s) created by DN MEYER using or incorporating the Content. You represent and warrant that (i) the Content does not and shall not infringe on any copyright or any other third party right nor violate any applicable law or regulation, (ii) you have the right to grant any and all necessary rights and licenses provided herein, including without limitation, all necessary copyright and other related rights to the Content, free and clear of all claims and encumbrances without violating the rights of any person or entity, including any right to privacy or publicity. You hereby hold BEHR harmless from and against any third party claim arising from use of the Content. You waive any right to privacy. You waive any right to inspect or approve uses of the Content or to be compensated in any manner for any such uses. You hereby represent and warrant that you are at least 18 years of age and that you have read this release and are fully familiar with its contents. Notes: Â· You must have consent from all persons depicted in the photograph you are submitting, including permission from parents of minors, and hereby represent and warrant that you have all such consent as required. Â· If your photo is published on the DN MEYER website, you further consent that your name, city and state will also appear next to your photo. If you do not wish for your name to be published, please let us know when submitting your photo. Â· If we select your photo for publication in the DN MEYER Show Your ColorsTM Promotion, you will be notified via e-mail using the address that you provide at the time of submission. Please be sure that any SPAM filtering that you may utilize is designed to accept e-mail from INSERT E-MAIL ADDRESS USED FOR NOTIFICATIONS so you don't miss this important information. All submissions for entry must be approved by an employee from DN MEYER (Promotion Administrators). ELIGIBILITY: This promotion is limited to legal residents of Nigeria. You must be 18 years of age or older to enter. Promotion is void where prohibited by law. ENTRY SUBMISSION: When participating in this promotion, you will be asked to provide first and last name, city, state, and email address. You will also be asked to select a project type, to describe the DN MEYERÂ® paint colors used in the project and the reason for painting. You will upload one (1) photo of the project. This photo must be in JPEG format and no greater than 500 k in size. You will then be asked to accept the DN MEYER release and rules. PHOTO SELECTION AND NOTIFICATION PROCESS: Once you have completed the entry process, the photo will be submitted to an internal review process by the DN MEYER Promotion Administrators. All non-selected photos are immediately deleted from the promotion database. Participants whose submissions are selected will be contacted by the Promotion Administrators, by phone or email, for announcement of selection and collection of additional information for posting on the Behr.com site. POSTING: DN MEYER will feature the selected photo and project on the designated photo page and may include a self photo of the submitting party or other information collected from him/her. Photo selection and publishing with occur at the Promotion Administrators’ discretion. Promotion Administrators will also determine the end date of this promotion. GENERAL CONDITIONS: No automated and/or repetitive submission of entries (including but not limited to entries using any script, macro, or sweepstakes services) will be accepted. By entering this promotion you give your consent for DN MEYER to deliver your submission and/or personal information to Promotion Administrators for the purpose of administering the promotion. Only Behr and Promotion Administrators will have access to the personal information. Information will be used in accordance with DN MEYER’s online privacy policy. In the event of a dispute as to who submitted an entry or the identity of an online participant, each online submission will be declared made by the authorized account holder of the email address attached at the time of submission. Authorized account holder is defined as the natural person who is assigned to an email address by an Internet Service Provider, online service provider, or other organization (e.g., business, educational institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address. The submitting participant may be required to provide DN MEYER and Promotion Administrators with proof that he/she is the authorized account holder of the email address associated with the selected photo.
